(b) “Customer” shall mean any individual or entity making a booking with the Company, including all persons named in the booking.
(c) “Services” shall include travel-related arrangements such as accommodation, transportation, tours, experiences, and ancillary services arranged by the Company.
(d) “Vendor” shall mean any third-party supplier, including but not limited to Destination Management Companies (DMCs), hotels, airlines, transport operators, and activity providers.
- The Company shall not be construed as a principal service provider except where explicitly stated;
- Performance of Services is subject to Vendor terms, conditions, and operational limitations.
3. Booking Request, Formation of Contract, and Confirmation
A booking request made by the Customer shall constitute an offer, which shall only be deemed accepted upon issuance of written confirmation by the Company.
A binding contract shall come into existence only when:
(i) the applicable advance payment has been received;
(ii) availability has been confirmed by the relevant Vendor(s); and
(iii) the Company has issued a written confirmation, invoice, or voucher.
The Company reserves the absolute right to decline any booking prior to confirmation without liability.
4. Payment Obligations at Booking Stage
The Customer shall pay 30% (thirty percent) of the total booking value as an advance. The balance amount shall be payable in accordance with the Payment Policy.
Failure to adhere to payment timelines shall entitle the Company to:
- cancel the booking without prior notice; and
- levy applicable cancellation charges.
5. Pricing, Dynamic Adjustments, and Cost Escalation
All prices quoted are indicative and subject to change until final confirmation. Post-confirmation, price adjustments may still arise due to:
(a) changes in government taxes, levies, or statutory charges;
(b) fluctuations in fuel cost or airfare;
(c) currency fluctuations (for international travel);
(d) unforeseen Vendor cost escalations.
The Customer agrees to bear such incremental costs upon reasonable notification.
6. Accommodation Standards, Occupancy, Child Policy, and Extra Bed
Unless otherwise expressly agreed in writing:
(a) Standard room occupancy shall be limited to two adults per room.
(b) A child sharing the bed with parents may be accommodated as per the age criteria defined by the respective hotel or Vendor; however, no additional bed shall be provided unless specifically booked.
(c) Any additional occupant or child exceeding the permissible age shall require an extra bed or mattress at additional cost.
(d) Extra beds may be provided as rollaway beds, sofa-cum-beds, or mattresses, subject to hotel policy.
(e) The classification of “child,” “adult,” and “infant” shall be determined solely by the respective Vendor and may vary across destinations.
The Company shall not be liable for variations in comfort, size, or type of extra bed provided.
7. Inclusions, Exclusions, and Scope of Services
The Services included in any booking shall be limited strictly to those expressly stated in the confirmed itinerary or invoice. Any service not specifically mentioned shall be deemed excluded.
8. Travel Documentation and Compliance
The Customer shall be solely responsible for obtaining and carrying all required travel documentation, including passports, visas, permits, and health certifications.
The Company shall not be liable for any denial of travel due to incomplete, incorrect, or invalid documentation.
9. Vendor Dependency and Third-Party Performance
The Company’s role being limited to facilitation, it shall not be responsible for:
- acts, omissions, delays, or defaults of Vendors;
- service deficiencies arising from third-party operations.
However, the Company shall make reasonable efforts to assist the Customer in resolving issues.
10. Amendments and Modifications
Any request for modification shall be subject to:
- availability;
- Vendor approval;
- applicable charges, including rebooking fees and fare differences.
No modification shall be deemed valid unless confirmed in writing.
11. Conduct and Termination Rights
The Company reserves the right to terminate Services without refund if the Customer:
- engages in unlawful or disruptive conduct;
- endangers safety;
- violates local regulations.
12. Limitation of Liability
To the fullest extent permitted by law, the Company’s liability shall be limited to:
- the amount actually paid by the Customer for the booking in question.
The Company shall not be liable for:
- indirect, incidental, or consequential damages;
- loss of enjoyment, profit, or opportunity.
13. Indemnity
The Customer agrees to indemnify and hold harmless the Company against any claims, losses, damages, or liabilities arising from:
- breach of this Policy;
- misuse of Services;
- violation of applicable laws.
14. Governing Law and Jurisdiction
This Policy shall be governed by the laws of India. Courts in Delhi shall have exclusive jurisdiction.
15. Severability and Savings Clause
If any provision of this Policy is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16. Waiver
Failure of the Company to enforce any provision shall not constitute a waiver of its rights.
17. Survival
Clauses relating to liability, indemnity, jurisdiction, and dispute resolution shall survive termination of the booking.
- 30 days or more: 10%
- 15–30 days: 25%
- 7–15 days: 50%
- Less than 7 days / No show: 100%
These charges are subject to Vendor overrides.
3. Vendor Override Clause
Where Vendor policies impose stricter terms, such terms shall prevail, and the Customer agrees to be bound accordingly.
4. Non-Refundable Components
Without limitation, the following shall remain non-refundable:
- flights;
- visas;
- permits;
- peak season bookings;
- promotional offers.
5. Refund Mechanism
Refunds shall be processed within 7–10 working days, subject to receipt of funds from Vendors.
6. Credit Note Substitution
Where refunds are not feasible, the Company may issue a credit note valid for 6 months, non-transferable, and subject to availability.
7. Force Majeure
In events beyond control, including natural disasters, pandemics, or government actions:
- no refund shall be due;
- alternative arrangements may be offered at the Company’s discretion.
8. No Show / Early Exit
No refund shall be provided for unused services or early departure.
9. Savings and Survival
All provisions relating to cancellation charges, liability, and Vendor dependency shall survive cancellation.

1. Payment Obligations
The Customer shall pay:
- 30% advance at booking;
- balance before travel as specified.
2. Payment Deadlines
- Domestic: 7 days prior
- International: 15 days prior
Failure shall result in cancellation without liability.
3. Accepted Modes
Payments may be made through approved channels including bank transfer, UPI, and cards.
4. Taxes and Statutory Compliance
All payments shall be subject to applicable taxes including GST and TCS.
5. Currency and Exchange Risk
All payments shall be made in INR. Any forex fluctuation risk shall be borne by the Customer.
6. Payment Failure and Chargebacks
In case of payment failure or chargeback:
- the Company reserves the right to cancel services;
- recover dues through legal means.
7. Fraud and Verification Rights
The Company may verify transactions and cancel suspicious bookings without liability.
8. Limitation of Financial Liability
The Company shall not be liable for:
- banking delays;
- gateway failures;
- incorrect payment instructions.
9. Severability and Savings
Invalid provisions shall not affect the enforceability of the remaining terms.

- the Booking Policy;
- the Cancellation & Refund Policy;
- the Payment Policy;
(all collectively referred to as “Policies”).
In the event of any conflict, this Agreement shall prevail unless expressly stated otherwise.
2. Legal Nature of Relationship
The Company acts as an independent intermediary and facilitator between Customers and third-party service providers (“Vendors”), including but not limited to:
- hotels;
- airlines;
- transport providers;
- Destination Management Companies (DMCs);
- activity operators.
Nothing contained herein shall be construed as creating:
- a partnership;
- joint venture;
- agency relationship (beyond facilitation);
between the Company and any Vendor.
3. Scope of Services
The Company provides curated travel planning and booking services, including:
- domestic and international tour packages;
- hotel reservations;
- transportation arrangements;
- experiences and guided tours.
All Services are subject to:
- availability;
- Vendor terms and conditions;
- operational feasibility.
4. Formation of Contract
A binding contract between the Customer and the Company shall arise only upon:
(a) receipt of the required advance payment;
(b) confirmation of Services by Vendors; and
(c) issuance of written confirmation by the Company.
Prior communications, quotations, or itineraries shall not constitute a binding agreement.
5. Pricing, Taxes, and Variations
All prices are subject to:
- change prior to confirmation;
- revision due to external factors including taxes, fuel surcharges, currency fluctuations, and Vendor pricing changes.
The Customer agrees to bear any incremental costs arising from such changes.
Applicable taxes, including GST and TCS (where relevant), shall be charged as per prevailing laws.
6. Payment Obligations
The Customer agrees to comply with the Payment Policy, including:
- payment of 30% advance at booking;
- payment of balance within stipulated timelines.
Failure to comply may result in cancellation without liability.
7. Cancellation, Refund, and Amendments
All cancellations, refunds, and amendments shall be governed by the Cancellation & Refund Policy.
The Customer acknowledges that:
- cancellation charges are reasonable and necessary;
- Vendor-specific policies may override standard terms;
- certain components are non-refundable.
8. Accommodation and Occupancy Policies
Accommodation is subject to Vendor-specific rules, including:
- maximum occupancy limits;
- child policies;
- extra bed/mattress provisions.
The Company shall not be liable for differences in:
- room size;
- extra bed type;
- amenities provided.
9. Customer Responsibilities
The Customer shall be solely responsible for:
- accuracy of personal details;
- possession of valid travel documents;
- compliance with local laws;
- health and fitness for travel.
The Company shall not be liable for consequences arising from failure to comply.
10. Third-Party Services and Vendor Liability
All Services provided by Vendors are governed by their respective terms.
The Company shall not be liable for:
- acts, omissions, or negligence of Vendors;
- delays, cancellations, or deficiencies in service;
- overbooking, strikes, or operational disruptions.
The Company shall, however, provide reasonable assistance in resolution.
11. Force Majeure
The Company shall not be liable for failure or delay in performance due to events beyond its control, including but not limited to:
- natural disasters;
- pandemics;
- government restrictions;
- political unrest;
- strikes or labor disputes.
In such cases, alternative arrangements or credit notes may be offered at the Company’s discretion.
12. Limitation of Liability
To the fullest extent permitted by law:
(a) The total liability of the Company shall not exceed the amount paid by the Customer for the specific booking.
(b) The Company shall not be liable for:
- indirect or consequential losses;
- loss of enjoyment or opportunity;
- personal injury or property damage caused by Vendors.
13. Indemnification
The Customer agrees to indemnify, defend, and hold harmless the Company from and against any claims, damages, liabilities, or expenses arising from:
- breach of this Agreement;
- misuse of Services;
- violation of applicable laws.
14. Right to Refuse or Terminate Services
The Company reserves the right to:
- refuse booking requests;
- cancel confirmed bookings;
- terminate Services without refund;
in cases involving:
- misconduct;
- fraudulent activity;
- safety concerns;
- violation of laws or policies.
15. Communication and Evidence
All official communication shall be recognized only if made in writing via:
- email;
- official messaging channels.
Such communication shall constitute valid evidence in case of disputes.
16. Intellectual Property
All content, itineraries, designs, and materials provided by the Company are its intellectual property and shall not be reproduced without consent.
17. Data Protection and Privacy
The Customer consents to the collection and use of personal data for:
- booking processing;
- communication;
- service delivery.
Data shall be handled in accordance with applicable Indian laws.
18. Dispute Resolution and Arbitration
In the event of any dispute:
(a) Parties shall attempt amicable resolution within 30 days.
(b) Failing which, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
(c) The seat of arbitration shall be Delhi.
(d) Proceedings shall be conducted in English.
19. Governing Law and Jurisdiction
This Agreement shall be governed by the laws of India. Courts in Delhi shall have exclusive jurisdiction, subject to arbitration provisions.
20. Severability (Savings Clause)
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
21. Waiver
Failure by the Company to enforce any provision shall not constitute a waiver of its rights.
22. Entire Agreement
This Agreement, along with all Policies, constitutes the entire agreement between the parties and supersedes all prior communications.
23. Amendments
The Company reserves the right to modify this Agreement at any time. Updated terms shall be binding upon publication.
24. Survival
Clauses relating to:
- liability;
- indemnity;
- dispute resolution;
- jurisdiction;
shall survive termination of Services.
25. Bookmywings Philosophy Clause
The Company operates on a written-first, guidance-driven model, prioritizing:
- clarity over pressure;
- transparency over persuasion;
- long-term trust over short-term transactions.
